Legislation wipes slate clean for Board of Nursing, mandates complete turnover by 2027

TOPEKA, Kan. — Gov. Laura Kelly has signed House Bill 2528, forcing the termination of all current State Board of Nursing members by Jan. 1, 2027, in an unusual structural overhaul of a state regulatory agency.

The bipartisan measure amounts to a legislative rebuke of the board's recent administrative actions. The new law voids all board actions related to certain nonpractice violations, restricts "unprofessional conduct" strictly to acts related to the practice of nursing and prohibits the board from retaliating against licensees for lawful actions — including establishing a civil cause of action if the board violates that prohibition.

The governor must now appoint interim board members subject to Senate confirmation. The legislation also requires the board to issue refunds for overpayments and duplicate payments and establishes a late license renewal process for professional, practical and advanced practice registered nurses.
