TOPEKA, Kan. — Governor Laura Kelly filed a lawsuit against Attorney General Kris Kobach in the Kansas Supreme Court Tuesday, alleging Kobach has failed to defend Kansas against federal overreach and has undermined her constitutional authority as the state's chief executive. The governor accused Kobach of partisan behavior, noting he frequently sued the previous presidential administration but has refused to challenge Trump administration actions that she says harm Kansas programs and cost the state millions of dollars.
The dispute centers on Kobach's refusal to join federal lawsuits protecting Kansas interests, forcing Kelly to independently challenge federal actions affecting nearly 188,000 Kansans who receive food assistance and other critical programs. Kelly's lawsuit seeks a court order preventing Kobach from interfering with her executive powers, citing the Kansas Constitution's designation of the governor as the state's "supreme executive." The legal battle escalated after Kobach previously sued Kelly's administration seeking to force release of Kansans' personal information to federal authorities, a case that was ultimately dismissed.
