# McPherson County commissioners to weigh enforceable low-frequency noise limits for rural homes

McPherson County commissioners meet at 9 a.m. Monday, Sept. 28, to consider a resolution setting enforceable decibel limits on infrasound and low-frequency noise reaching rural homes, with testing costs billed to operators.

Planning/Zoning/Environment Director Jon Kinsey is scheduled to present the draft at 9:10 a.m. in the fifth-floor meeting room of the McPherson County Building, 200 N. Maple, after public input at 9 a.m.

The draft defines infrasound as airborne sound below 20 hertz and low-frequency sound as 20 to 200 hertz. It would cap sound below 20 hertz at 3 decibels over the surrounding ambient level, sound from 20 to 200 hertz at 5 decibels over ambient in one-third octave bands, and audible sound at 50 dBA daytime and 40 dBA at night measured outside a dwelling.

The county could add a 5-decibel penalty to measured sound showing tonal, impulsive, repetitive-cyclic or amplitude-modulation characteristics, and could find a use noncompliant even where it meets the numbers if evidence shows persistent interference with sleep, rest or quiet enjoyment.

The standards would apply to any new, expanded, repowered, materially modified or intensified use, public or private, that can be measured at or beyond the source parcel's boundary. A lawfully existing use could continue as it is but could not expand or repower without first demonstrating compliance.

Protected receptors are defined to include dwellings, schools, churches, hospitals, nursing facilities and licensed care facilities. Applicants would owe an acoustical impact study, baseline ambient data, predicted levels at each receptor, proposed mitigation and post-construction testing protocols.

Unless the board decides otherwise, the applicant or operator would bear the reasonable cost of studies, testing, review and retesting. The county's remedies would include permit suspension, withholding further approvals, curtailment of operations, injunctive relief and nuisance abatement.

The draft lists among its purposes to "preserve reasonable residential quiet enjoyment in the unincorporated area," and says it would take effect on passage and publication in the official county newspaper.

Neither the agenda nor the draft names any operation, complaint or pending application that prompted the resolution. The county banned commercial wind and solar projects, data centers, and battery storage systems countywide.
